Questions to Ask Before Choosing Your Family Law Attorney

Preparing for your divorce can be a challenging time.  Not only will you be dealing with the emotional stress that accompanies the end of your relationship, but also with the logistics of separating, finding a new place to live, gathering important documents, and crafting a new visitation schedule are just a few tasks you will need to face.  One of the most important things you will need to do is select a family law attorney to help you navigate your divorce.  Choosing the right divorce attorney is important because you may be working with this same attorney for months or even years, especially where there are post-divorce issues concerned.  There are some questions you need to ask before making the final decision on which attorney to retain.

One important issue is to determine if the attorney’s style is compatible with your goals in your case.  For example, some attorneys are extremely aggressive and will want to file many motions and requests for discovery.  This type of strategy is very effective in some cases, but is not right for every case.  If you are looking to get your case settled as soon as possible with a minimum of fuss, it may be better for you to seek out an attorney who takes a gentler and more conciliatory approach.

Another issue is how much your attorney will charge and how he or she approaches billing.  Some attorneys obviously charge more than others, but having an attorney that is the most expensive will not always be the best choice for you.  If you have a limited budget, it will not be a good idea to hire a very costly attorney, as when you run out of money, you will be left without a lawyer before your case is over.  Speak to your potential attorney about your budge and how the two of you can work together within that budget to make sure you have the right type of representation that can last throughout the case.

Finally, you will want to ask your potential attorney about how often he or she handles family law cases, especially if your case is complex.  While it is not necessary to hire an attorney that only handles family law, having an attorney who is experienced in the challenges and nuances of divorce or custody issues can help you achieve your goals.
