To file for divorce in Minnesota, you or your spouse must live in the state (or be a military member stationed in the state) for at least 180 days.
As a “no-fault” state, Minnesotans can file for divorce by citing “an irretrievable breakdown of the marriage relationship.” This means it is not necessary to prove that a spouse’s behavior was what led to the divorce.
Once you have reached the state requirements, you can file for divorce. To do so, you must fill out the following forms and file them with the county court. Your divorce attorney can assist you with this process. Once you have completed this step, you must serve your spouse divorce papers (you yourself cannot do this, but a law enforcement professional can). Your spouse will respond and then you and your spouse will determine which type of divorce you would like to pursue moving forward.
